A Contract Is A Contract
In the current employment situation, with furlough ending and changes in the air, it may well be your wish as an employer of domestic/household staff to want a speedy dismissal of an employee.
However, it must be remembered that a contract is a contract and before taking any action, employers should check the contract of an employee.
If the employee’s contract states, for example, that they are to be given 8 weeks written notice of termination of employment, that is their entitlement unless their dismissal was a direct result of Serious Misconduct.
Some examples of Serious Misconduct may include theft, fraud, assault, or refusing to carry out a lawful and reasonable instruction that is part of the job.
If the above conditions do not apply, the very least an Employment Tribunal will do is to award the former employee their net wages for the period in which they should have been paid, i.e. their notice of termination. Further costs may also be awarded.
