Can I Change…

Can I Change The Terms Of An Employee’s Contract Of Employment?

We now live in a changed and changing world and one of the things, as an employer of domestic/household staff you may want to change, are their terms and conditions of contract.  But are you permitted to change their contract of employment in this way? And if so, how do you go about it?

Remember, their contract of employment is exactly what it says, a contract, agreed by both sides.

Firstly, there has to be a good reason and, secondly, you do need the agreement of the employee to make any changes, for the reasons stated above.

If they are not agreeable you only really have one option, and that is to enforce any changes with the fire and re-hire procedure, but this has received very bad publicity recently and does not generate good relations.  The procedure has risks, and does leave you open to employment tribunal challenges.
