Employment Claims Time Limit Against Employers May Be Extended
The Law Society is backing the call for the government to increase the time limit in which an individual can bring an employment tribunal claim from three months to six.
It said “urgent action” was needed to clear the backlog of employment tribunal cases that have accumulated since fees were judged in 2017 to be unlawful.
In April 2020 the Law Commission, an independent body examining reform of the legal system in England and Wales, recommended an extension to the time limit for employment tribunal claims and proposed that tribunals should have the power to extend time limits in all cases when they consider it “just and equitable” to do so.
The government wrote to the Law Society at the beginning of July to ask for its views on proposals to improve the running of employment tribunals.
