How Are Employment Tribunal Awards Calculated?
As an employer you hope and assume that interactions between yourself and employees, including Domestic and Household, will always be conducted in ways which both parties can accept. However, there are occasions when actions lead employers to face allegations at an Employment Tribunal. For most of us, how claims are awarded is an unknown area.
To bring you up to date, the Employment Tribunal compensation rates are increasing again effective from April 6th. A successful Claimant’s Basic Award is calculated in the same way as Statutory Redundancy Pay (see our Statutory Redundancy pay article in this newsletter.)
Where a Claimant is judged to have been unfairly dismissed (other than in automatic unfair dismissal cases), they are entitled to a compensatory award of a maximum of 52 actual weeks’ pay, subject to an overall cap. That capped allowance rises to £93,878 (from £89,493).
