Maternity discrimination
Most people would agree that during pregnancy, women have to be accorded some leeway for health, absence, etc. As most domestic staff are female, particularly housekeepers and those with ancillary roles such as nanny and cook, it is important that you, as their employer, are aware of all their rights.
What many are unaware of is that during pregnancy and maternity leave, pregnant women enjoy special protection under the law.
This protection provides that any dismissal or treatment which could be considered detrimental due to their pregnancy, amounts directly to pregnancy or maternity discrimination.
Additionally, women placed in this position may also be able to claim that the treatment or dismissal equates to sex discrimination.
If you find yourself in a position therefore where you are perhaps contemplating dismissing someone during this period of special protection, it will be in your interest to take expert advice.
