You Have An Emergency With A Dependant, What Are Your Rights To Time Off?

In the  first instance let’s define a “dependant”.

A dependant could be a spouse, partner, child, grandchild, parent, or someone who depends on you for care.

Emergencies will happen, so what can you expect in terms of time off to deal with the situation? Well, you are allowed a “reasonable”  amount of time, but it’s not set in stone as it very much depends on the situation

If, for instance, your child falls ill you could take time off to go to the doctor and, following that to make care arrangements.

However after this, if you want to take a longer period off,  your employer may then ask you to take annual leave or parental  leave. It is always a good idea to discuss the situation with your employer as soon as possible.

Although there are no limits on how many times you can take time off for dependants, it is probable that your employer will want  to discuss issues with you if they think it excessive or is affecting your work.

Whether or not your employer decides to pay you for the time you take off in this situation is entirely up to them. There maybe a clause covering this in your contract of employment.

The situation is different, however, if you knew about the need for time off beforehand, for instance, a doctor’s or hospital appointment. This would not constitute an emergency, your employer would not be obliged to pay you and could ask you to take the time as part of your leave or Parental leave.
